Hereinafter referred to as: "Fluppe Burger", "Philippe Meirlaen", "we" or "us".

2. Scope of these terms

These general terms and conditions apply to any use of the website www.fluppeburger.com, to all requests, collaborations, commercial agreements, promotional activities and any reservations or orders related to the Fluppe Burger concept.

By using this website or contacting us in relation to Fluppe Burger, the user declares to have read these terms and to accept them.

3. Description of the concept

Fluppe Burger is a culinary brand and burger concept developed and commercialised by Philippe Meirlaen.

Philippe Meirlaen is responsible for:

  • the development of the burger concept;
  • the recipes and flavour profiles;
  • the spice blends and sauce concepts;
  • the branding and marketing;
  • the commercial development of the concept;
  • the communication and promotion around Fluppe Burger;
  • the selection of and coordination with professional partners.

4. No own food production by Philippe Meirlaen

Philippe Meirlaen does not produce food for sale to consumers himself.

The actual preparation, production, processing, storage, sale or serving of food is carried out exclusively through or in collaboration with professional partners, such as catering companies, hospitality venues, restaurants, food trucks or other operators that are legally compliant.

Philippe Meirlaen mainly provides the concept, the recipes, the marketing, the brand identity and the commercial support.

5. Cooperation with FASFC-approved partners

For the practical execution of Fluppe Burger, we work with professional partners that, where required, hold the necessary authorisations, registrations or approvals from the Federal Agency for the Safety of the Food Chain (hereinafter "FASFC" / Belgian: FAVV).

Each partner involved in the production, preparation, storage, transport, sale or serving of food is itself responsible for complying with all applicable rules on food safety, hygiene, allergens, traceability, labelling and other legal obligations.

6. Responsibility of executing partners

Restaurants, caterers, food trucks or other operators that prepare or sell Fluppe Burger remain fully responsible for their own operations.

This includes, among others:

  • food safety;
  • hygiene;
  • purchase and storage of ingredients;
  • correct preparation;
  • allergen information;
  • temperature control;
  • sale to consumers;
  • point-of-sale systems and payments;
  • permits, licences and insurance;
  • compliance with all hospitality and food legislation.

7. Recipes, sauces and intellectual property

All recipes, spice blends, sauce concepts, brand names, texts, logos, marketing concepts, images, ideas and commercial developments related to Fluppe Burger remain the property of Philippe Meirlaen, unless otherwise agreed in writing.

It is not permitted to copy, reproduce, sell, use or commercialise the concept, the name, the recipes, the sauces, the spice blends, the branding or other elements of Fluppe Burger, in whole or in part, without the prior written consent of Philippe Meirlaen.

8. Use of the name "Fluppe Burger"

The name Fluppe Burger may only be used by partners, hospitality businesses, caterers or other parties with whom Philippe Meirlaen has concluded an explicit written agreement to that effect.

Any unauthorised use of the name, the concept or the branding may result in the immediate cessation of use and, if necessary, further legal action.

9. Collaborations and commercial agreements

Collaborations around Fluppe Burger are always discussed separately and confirmed in writing.

Agreements regarding production, sales, commissions, recipes, deliveries, marketing, exclusivity, locations, events or use of the brand name are only binding once they have been confirmed in writing by Philippe Meirlaen.

10. Information on the website

Philippe Meirlaen takes care with the content of this website, but cannot guarantee that all information is at all times complete, accurate or up to date.

Information on products, collaborations, events, availability, prices or locations may change at any time without prior notice.

11. Allergens and nutritional information

Because Philippe Meirlaen does not himself produce or sell food to consumers, allergen and nutritional information is provided by the executing partner responsible for the actual preparation and sale.

Consumers with allergies, intolerances or specific dietary questions should always inquire directly with the caterer, restaurant, food truck or operator offering Fluppe Burger.

12. Liability

Philippe Meirlaen is not liable for any direct or indirect damage arising from:

  • the use of this website;
  • incorrect or incomplete information;
  • technical malfunctions;
  • decisions made on the basis of website information;
  • the practical execution by external partners;
  • food preparation, sale or service by third parties;
  • allergen or food safety incidents involving external operators.

13. Contact forms

When visitors fill out a form via the website, the provided data is used to process the request and to make contact.

All contact forms on the website are forwarded to fluppeburger@philippemeirlaen.be.

By filling out a form, the visitor declares to provide accurate information.

14. Privacy

Personal data is only used for communication, follow-up of requests, commercial contacts or collaborations around Fluppe Burger.

Data is not sold to third parties. If data is shared with partners, this is only done when necessary for handling a concrete request or collaboration.

16. Applicable law

These general terms and conditions are governed by Belgian law.

In the event of a dispute, the parties will first attempt to reach an amicable solution. If this is not possible, the competent courts of the judicial district in which Philippe Meirlaen is established shall have jurisdiction, unless mandatory legal provisions provide otherwise.
